ABANDONMENT OF LOTS A lot shall be deemed abandoned under any of the following circumstances: A. Non-Payment -Full payment is not received within the stated invoice deadline of 15 business days. -A payment method is declined, reversed, disputed, or otherwise fails. -The buyer refuses or fails to respond to payment reminders within 15 business days of auction close. Non-payment constitutes default and immediate forfeiture of bidding privileges at the discretion of Pine Lake Auctions LLC. B. Failure to Pick Up Paid Items Paid lots shall be considered abandoned if: -Items are not picked up during the scheduled pick-up days , AND -No prior written or verbal arrangement has been approved by Pine Lake Auctions LLC, AND -The buyer fails to retrieve items within ten business days after auction close. Warehouse space is limited due to monthly auction turnover. Buyers are responsible for knowing pick-up dates before bidding. C. Failure to Arrange Shipping If shipping is offered: -Buyer must request shipping before the end of the final scheduled pick-up day unless otherwise stated. -Buyer must provide valid shipping information and payment authorization. -Failure to respond to shipping invoices within five business days will result in abandonment. D. Extend Deadlines Phone calls, emails, or messages and confirmed agreements between a buyer and Pine Lake Auctions may extend pick-up or payment deadlines. E. Transfer of Ownership Upon abandonment determination: -All rights, title, and interest in the lot immediately revert to Pine Lake Auctions LLC and/or the consignor. -Buyer relinquishes any claim to ownership. -Buyer waives any right to refund, replacement, or credit. 4. FORFEITURE & REMEDIES Upon determination of abandonment, Pine Lake Auctions LLC may exercise any or all of the following remedies without further notice: A. Resale of Property -Abandoned lots may be re-entered into a future auction. -Lots may be sold privately. -Lots may be returned to the original consignor. -Lots may be donated or disposed of at Auctioneer’s discretion. -The original buyer shall have no claim to proceeds from any resale. B. Forfeiture of Payments -Any payments made prior to abandonment are non-refundable. -Buyer forfeits buyer’s premium, applicable fees, and taxes paid. -No store credit or future auction credit will be issued. C. Storage & Handling Fees (If Applicable) Pine Lake Auctions LLC reserves the right to assess: -Storage fees of $_1_ per lot per day Handling fees -Labor fees for moving, palletizing, or re-inventorying items Fees may exceed the original purchase price. If unpaid, items may immediately be deemed abandoned without further notice. D. Collection & Legal Action Pine Lake Auctions LLC reserves the right to: Pursue collection for unpaid invoices. -Recover attorney fees, court costs, and administrative expenses. -Send delinquent accounts to collections. -Report unpaid invoices to third-party bidding platforms including HiBid.
